Terms of Service
These terms govern your use of CreatorMarkt — the marketplace where brands publish briefs, creators apply, and the platform holds the budget in escrow until deliverables go live and perform. By creating an account or using any part of the service you agree to these terms.
1. Who we are
"CreatorMarkt," "we," "us," or "our" means CreatorMarkt, the operator of creatormarkt.app. Contact us at hello@creatormarkt.app.
2. Eligibility & accounts
- You must be at least 18 years old and able to enter binding contracts under the laws of your country.
- You must provide accurate information at signup and keep it current. Brands sign up on behalf of a real legal entity they are authorised to bind.
- One account per person or entity. You are responsible for everything that happens under your account, including credential security.
- We may suspend or terminate accounts that violate these terms, that we suspect of fraud, or that we are legally required to remove.
3. Roles on the platform
Brands
Brands publish briefs describing the content they want, set a flat rate and an optional bonus, choose target platforms, and accept applications from creators. Once an application is accepted, the brand funds the agreed amount into escrow via Paystack.
Creators
Creators apply to briefs, submit drafts, post the approved content on their own social accounts, and submit the live URLs back to the platform for verification.
4. The marketplace flow
- Application. A creator applies to a brief.
- Acceptance & funding. The brand accepts the application and funds the budget through Paystack. We hold the funds in escrow.
- Draft & approval. The creator submits a draft. The brand approves it or requests changes.
- Going live. The creator publishes on the agreed platforms and submits the live URLs.
- Verification. Our scrapers (via Apify and the platforms' public APIs) collect view counts and engagement metrics from the public post.
- Payout. The flat tier is released to the creator once the post is verified live; the bonus tier is released if the per-platform views goal is met before the bonus deadline.

5. Content ownership & licence
Creators retain copyrightin the content they make. Unless the brief explicitly says otherwise, by accepting payment for an approved brief the creator grants the brand a non-exclusive, worldwide royalty-free licence to use, reproduce, and repost the deliverables for the brand's own marketing purposes for one year from the date the post goes live. Briefs may extend or modify this licence; any additional rights (exclusivity, perpetual use, paid-media usage rights, etc.) must be agreed in writing inside the brief and may carry additional fees.
Brands grant CreatorMarkt a non-exclusive licence to display their logo, trade names, and brief content on the platform for the purpose of running the marketplace. Creators grant CreatorMarkt the right to read public metrics from posts they submit so we can verify performance and compute payouts.
6. Prohibited use
- Posting content that is illegal, defamatory, sexually explicit (without an explicitly age-gated brief), discriminatory, or that infringes anyone's rights.
- Using bots, view-buying, engagement pods, or any other artificial method to manipulate the metrics that drive bonus payouts. We reserve the right to invalidate metrics we believe are inauthentic and withhold or claw back the corresponding bonus.
- Soliciting brands or creators to take the engagement off-platform to avoid platform fees.
- Reverse-engineering, scraping, or otherwise abusing the platform.
7. Fees
Brands pay a tiered platform fee on top of the brief budget at funding time: 10% for briefs under ₦500,000, and 5% for briefs at or above ₦500,000. Creators receive 100% of the flat and bonus amounts shown on the brief, less any payout charges levied by their bank. Fees may change on prospective briefs; existing funded escrows are governed by the rate at the time of funding.
8. Disclaimers
The service is provided "as is." We do not guarantee that any brief will receive applications, that any post will reach a particular view count, or that any social platform will keep a post live. Metric snapshots are based on data the platforms expose publicly — when a platform changes, breaks, or rate-limits its surface, our numbers can be delayed or imperfect.
9. Limitation of liability
To the maximum extent allowed by law, CreatorMarkt is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability arising out of these terms is limited to the platform fees you have paid us in the twelve months before the claim arose.
10. Indemnity
You agree to indemnify and hold CreatorMarkt harmless from claims arising out of content you post, your breach of these terms, or your violation of any third party's rights — including intellectual property, publicity, or platform terms-of-service claims.
11. Termination
Either side can close their account at any time. We can suspend or terminate accounts immediately for breach of these terms, suspected fraud, or legal obligation. Sections that by their nature should survive termination — including content licences for already-delivered posts, payment obligations, disclaimers, and limitation of liability — survive.
12. Changes
We may update these terms. Material changes are signalled by bumping the version stamped above; we will ask you to re-accept on next sign-in. Continued use after re-acceptance is your agreement to the updated terms.
13. Governing law & disputes
These terms are governed by the laws of the Federal Republic of Nigeria. Disputes are first attempted by good-faith negotiation; if unresolved, they are submitted to the courts of Lagos, Nigeria. Nothing here removes any non-waivable consumer rights you have under your local law.
